KNOW ALL MEN BY THESE PRESENTS,
That we, William Hess as principle, and Martin M. Hess as security are held and firmly bound unto Elva Jane Hess in the just and full sum of Three Hundred and Twenty dollars for the payment whereof, well and truly to be made, we bind ourselves, our heirs, executors, and administrators, firmly, by these presents. Signed with our hands, and sealed with our seals, and dated at Batesville this 8 day of October A.D. 1848.
The condition of this obligation is such, That whereas, the said William Hess was, on the 3rd day of October A.D. 1848, appointed, by the Court of Probate of the county of Independence, Guardian of Elva Jane Hess, a minor under the age of twenty one years: Now, if the said William Hess shall duly render, according to law, just and true accounts of his guardianship, and if the said William Hess, his heirs, executors, or administrators, upon the determination or ceasing of such guardianship, shall deliver and pay to the said Elva Jane Hess her executors or administrators, or any guardian that may be appointed to the said Elva Jane after the determination or ceasing of the guardianship of the said William Hess all the money, property, and effects, belonging to her in the possession or under the control of the said William Hess and that shall be due to her from the said William Hess and if the said William Hess shall, in all things, faithfully perform and fulfill his duty as guardian, as aforesaid, then this obligation shall be void and of none effect; otherwise, to be and remain in full force and virtue.
