In the Probate Court of Independence County in vacation before the clerk then of this 26th day of September 1861.
Be remembered that on this day personally appeared before me, John A. Price, Clerk of the Circuit Court and Ex-Officio Clerk of the Probate Court, within and for the county of aforesaid, Charles O'Neal and John J. Hancock who, first being duly sworn for that purpose, do depose and say that they are subscribing witnesses to the forgoing instrument of writing purporting to be the last will and testament of William Hess, and that the said William Hess acknowledged to them that he had signed the same in their presence and that they signed the same as attesting witnesses thereto at the request of the said testator and in his presence and at the time of signing the same the said testator was in sound mind and disposing memory and at the time the same was signed the said testator published and declared in their presence that the forgoing instrument of writing to be his last will and testament.
